1. Service Description

RivalShift ("the Service") is a web-based platform that monitors publicly accessible competitor websites for changes and delivers AI-powered analysis of those changes. The Service is operated by RivalShift ApS ("we", "us", "our").

2. Account Terms

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account.
  • One person or entity may not maintain more than one account.
  • You must be at least 18 years old or the legal age in your jurisdiction to use the Service.

3. Acceptable Use

You agree not to:

  • Use the Service to monitor websites you do not have a legitimate competitive interest in monitoring.
  • Attempt to circumvent rate limits or abuse the crawling infrastructure.
  • Use the Service to collect personal data about individuals.
  • Resell, sublicense, or redistribute data obtained through the Service without prior written consent.
  • Interfere with or disrupt the Service or its infrastructure.

4. Subscriptions & Billing

  • The Service offers paid subscription plans billed monthly via Stripe.
  • All prices are in Danish Kroner (DKK) and are exclusive of applicable taxes.
  • Subscriptions automatically renew at the end of each billing period unless canceled.
  • You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored until renewal.

5. Free Trial

We may offer a free trial period. If you do not subscribe before the trial ends, your access to paid features will be suspended. No charge will be made unless you explicitly subscribe.

6. Website Monitoring & Crawling

The Service crawls publicly accessible web pages. We respect robots.txt directives and identify ourselves via a custom user agent. We do not access password-protected content, bypass authentication, or circumvent access controls. If a website owner requests that we stop crawling their site, we will comply promptly.

7. Intellectual Property

The Service, including its design, code, and AI models, is the intellectual property of RivalShift ApS. You retain ownership of any data you provide to us. The change analysis and reports generated by the Service are provided for your internal business use only.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of change detection or AI analysis. Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time from the Settings page, which will permanently remove all your data.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These terms are governed by the laws of Denmark. Any disputes shall be resolved in the courts of Copenhagen, Denmark.
